HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12210 OF 2017 ORDER:
The case of the petitioners is that they are the absolute owners of agricultural land admeasuring Ac.5-00 cents in Sy.No.370 of Old Singarayakonda Village and Mandal, Prakasham District. They made a representation on 23.05.2016 to the respondents requesting them to grant assignment pattas in their favour. While so, on complaint made by the 5th respondent on 13.06.2016 before the 2nd respondent alleging that he was granted assignment patta to an extent of Ac.2-00 cents in Sy.No.366/2, the respondent authorities are insisting the petitioners to vacate from the subject land. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. It is to be seen that petitioners have already ventilated their grievance by way of representation dated 15.03.2017 before the 2nd respondent. From the averments stated in the affidavit, it is found that petitioners are claiming the land in Sy.No.370 whereas the 5th land is claiming the land in Sy.No.366/2.
Since it is stated that the 4th respondent has already submitted a report before the District Collector-2nd respondent, the 2nd respondent is directed to dispose of the
representation submitted by the petitioners on 15.03.2017, after issuing notice to the petitioners as well as the 5th respondent and take action accordingly within a period of two
(02) months from the date of receipt of copy of this order. With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.04.2017 dv
