Despite listing the matter under the caption "for dismissal", Sri A. M. Uddin, learned counsel, representing Sri Vijay Ashrit, learned counsel for the Revision Petitioners, requested time initially on the ground that due to personal inconvenience, the counsel on record is unable to appear before the Court. When the Court is not inclined to adjourn the matter, he represented that the counsel is out of station and sought time. But, neither of the representations appears to be true. Even on the last occasion, when the matter reached for admission, there was no representation. Therefore, this Court having no other alternative listed the matter under the caption 'for dismissal.
Even today, Sri A. M. Uddin, learned counsel appearing on behalf of the petitioners, conveniently sought time on one pretest or the other and such request cannot be accepted as the matter is listed under the caption " for dismissal". Despite it, the counsel did not choose to advance arguments. Therefore, this Court has no option except to dismiss the present Civil Revision Petition for non-prosecution.
Accordingly, this Civil Revision Petition is dismissed for non prosecution, but without costs.
As a sequel, miscellaneous petitions, if any, pending in this case, shall stand closed.
