HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.4299 of 2015 ORDER :

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed by the petitioner/plaintiff aggrieved by the docket order dated 18.09.2015 in I.A.No.164 of 2015 in O.S.No.574 of 2008 passed by the XII Additional Chief Judge, City Civil Court, Hyderabad, referring the matter to the Mediation Centre with an observation that both parties shall cooperate before the mediator to mediation centre.

2. Learned counsel for the petitioner/plaintiff submits that though the aforesaid application is filed to refer the matter for settlement to mediation centre, no notice is served and no opportunity is given to the petitioner/plaintiff to put-forth her case.

3. When this Court has asked the learned counsel for the parties whether they are agreeable for settlement of disputes by way of mediation, it is submitted by both the learned counsel that the parties are not agreeable for mediation and requested that the matter be considered and decided by the Court only.

4. In that view of the matter, the impugned order dated 18.09.2015 is set aside. It is left open to the Court below to dispose of the suit on merits, as expeditiously as possible.

5. Subject to the above direction, this civil revision petition is disposed of, at the stage of admission. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs. ____________________________ JUSTICE R. SUBHASH REDDY
