THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5935 of 2015 ORDER:
The writ petitioner questions the inaction of the 2nd respondent in disposing of the revision filed by him or the stay application filed along with the revision.
2. The averments in the writ affidavit would show that the petitioner was granted D-Form patta on 07.06.1992 for the land admeasuring Ac.5-08 cents in Survey No.17-6, Kunuthur village, Dharmavaram mandal, Ananthapuramu district by the 3rd respondent-Tahsildar and since then he is in continuous possession and enjoyment of the said land. While so, challenging the assignment in my favour, the 6th respondent filed an appeal before the 4th respondent on 24.11.1996, and the 4th respondent without putting the petitioner on notice, passed order on 13.06.2000 canceling the assignment made in favour of the petitioner. Aggrieved of the action of the 4th respondent, the petitioner preferred a revision before the 3rd respondent raising several grounds. The petitioner also filed W.P.No.
20218 of 2000 and this Court granted stay of eviction till the appeal is disposed of before the 3rd respondent. The 3rd respondent, without considering the grounds raised by the petitioner, passed order dated 05.01.2015 confirming the orders of the 4th respondent. Challenging the same, the petitioner preferred a revision before the 2nd respondent, and along with the revision he filed a Stay petition seeking to stay the orders of the 3rd respondent. It is his grievance that the 2nd respondent has neither disposed of the Stay application nor the Revision till date.
3. Heard the petitioner's counsel, the learned Government Pleader and perused the record.
4. Considering the fact that this Court granted stay of eviction in
W.P.No.20218 of 2000 till the appeal is disposed of before the 3rd respondent, and further considering that the Revision as well as the Stay application are pending before the 2nd respondent, this writ petition can be disposed of by directing the 2nd respondent to dispose of the Stay application, and preferably the Revision itself as expeditiously as possible. Till such time the Stay application is disposed of by the 2nd respondent, there shall be Stay of eviction proceedings against the petitioner.
5. With the above direction, the writ petition is disposed of. No costs.
Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
