Heard Praveen Kumar Veerjala for petitioner and Mr.P.Govind Reddy for respondent No.3.
The petitioner prays for mandamus declaring the inaction of respondent No.3 in considering petitioner's candidature for admission into B.Sc. (Agriculture) and BVSc. (Horticulture) under quota meant for children of Farmers despite uploading all the certificates of petitioner, as illegal and arbitrary. Standing Counsel for respondent No.3-University has placed before the Court, hard copy of uploaded application of the petitioner. While admitting the details furnished under the caption 'documents uploaded', learned Standing Counsel forcibly contends that when application is downloaded, the downloaded copy must include Form-II as well. Therefore, the narration 'documents uploaded' cannot and could not be treated as due compliance by the petitioner. The objection, no doubt, requires consideration, but the fact of the matter is the omission in upholding Form-II certificate by petitioner cannot be, at this point of time, examined and decided to ascertain whether the petitioner is right or respondent No.3 is right in refusing to consider petitioner's case under Farmers' quota.
However, the details recorded in the uploaded documents are not doubted for the limited purpose of disposing the writ petition. For the present, keeping in mind the rank of the petitioner, the other certificates filed by her to merit her candidature under Farmers' quota and to meet the ends of justice, this Court directs respondent No.3 to permit the petitioner to participate in counselling scheduled to be held today. As and when the petitioner on her turn of merit appears, respondent No.3 is directed to consider her in the quota meant for Farmers. It is for respondent No.3 to examine the merit and take a decision as is warranted in the fact situation of this case. Since time even for communicating the copy of order is literally unavailable, learned Standing Counsel is directed to communicate the gist of this order to respondent No.3 for appropriate compliance. The petitioner to report by referring to this order. Writ petition is ordered as indicated above.
