HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36596 of 2016 ORDER:

1) Heard learned counsel for the petitioners and Government Pleader for Revenue. With consent of both the parties the writ petition is taken up for hearing at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus to declare that the land of the petitioners admeasuring Ac.20.12 gts., in Sy.Nos.83 and 84 of Jalpally Village, Saroornagar Mandal (Now Balapur Mandal), Ranga Reddy district mentioned in the prohibitory list under Section 22-A of the Registration Act, as illegal, arbitrary and contrary to law; and consequently direct respondent No.2 to delete the said land from the prohibitory list as per the reports of the Revenue Divisional Officer, Ranga Reddy district vide reports dated 24.03.2015 and 09.05.2016 and to direct respondent No.

4 to entertain the sale documents submitted by the petitioners for registration in respect of land admeasuring Ac.10.06 gts. in Sy.No.83 and Ac.10.06 guntas in Sy.No.84 treating it as patta lands in favour of the prospective purchasers/ buyers as per the provisions of law without reference to the prohibitory list.

3) Though various grounds are raised, learned counsel for the petitioners mainly submits that in the month of October, 2015, the petitioners herein are made a representation to the Collector seeking issuance of necessary directions to the concerned revenue

authorities to delete the land of the petitioner from the prohibitory list as the said land is a patta land and the name of one Mohammed Chand was recorded as pattadar. Learned counsel for the petitioners also refers to the letter dated 12.11.2015 addressed to the Tahsildar, Saroornagar Mandal by the Collector, Ranga Reddy District and also the letter dated 24.03.2016 written by Deputy Collector, Saroornagar Mandal to the Special Grade Deputy Collector and Revenue Divisional Officer, Saroornagar Division, Ranga Reddy District, pointing out that the land of the petitioners cannot be further detained from registration.

4) The Government Pleader for Revenue on instructions submits that as per the Full Bench Judgment of this Court the enquiries are in progress to prepare a revised 22-A Prohibitory Register mentioning only Government interested lands and after completion of enquiries, Prohibitory Registers will be published afresh. But however, learned counsel for the petitioners would submit that it may take sufficiently long time for the entire exercise to be completed and hence seeks a direction to pass orders on his application.

5) Without going into the merits of the case and having regard to the submissions made, the District Collector, Ranga Reddy District, shall consider the application made by the petitioners in accordance with law, as early as possible, preferably, within a period of six (06) weeks from the date of receipt of a copy of the order. There shall be no order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
