THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34945 OF 2018 ORDER :

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development, appearing for the first respondent, and Sri Neeli Ashok Kumar, learned Standing Counsel for GHMC, appearing for respondent Nos.2 to 4, apart from perusing the entire material available on record.

A show cause notice, bearing No.UC/3/67/TPS/C12/ W10/2018, dated 27.08.2018, issued under Sections 452 (1) and 461 (1) of the Hyderabad Municipal Corporation Act, 1955, is under challenge in the present Writ Petition. According to the petitioner herein, in response to the said show cause notice, she submitted an elaborate explanation on 03.09.2018 but, without considering the same, the respondent authorities are highhandedly trying to demolish the subject constructions.

Having heard the learned counsel on either side, and as the explanation, offered by the petitioner herein is pending consideration, this Court deems it appropriate to dispose of the Writ Petition with a direction to the respondents to consider the explanation, dated 03.09.2018, said to have been submitted by

the petitioner herein, and take further action/pass appropriate orders, strictly in accordance with law, as expeditiously as possible. Till the said exercise attains finality, no coercive action, pursuant to the impugned notice, shall be taken. Accordingly, Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
