THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN CONTEMPT CASE NO.2181 OF 2013 ORDER:
The order, violation of which is alleged in this Contempt Case, is the order passed in WP.No.24603 of 2011 dated 13.12.2012.
The said order required the District Collector to cause an enquiry as to whom the subject land was allotted by the Government in G.O.Ms.No.340 dated 26.06.2009; to give both the petitioner and the fourth respondent an opportunity of being heard; and thereafter, to pass orders in accordance with law. The entire exercise, culminating in an order being passed by the District Collector, was directed to be completed at the earliest and, in any event, not later than four months from the date of receipt of a copy of the order. While the order of this Court was required to be complied with by May/June, 2013, the order was passed by the District Collector on 04.02.2016. An elaborate counter affidavit is filed explaining the delay. The respondent has also expressed unconditional apology for the delay in implementing the order passed by this Court earlier. In the light of explanation furnished in the counter affidavit, and as the officer has expressed regret, I see no reason to proceed against her under the Contempt of Courts Act, 1971. The Contempt Case is, accordingly, closed.
Miscellaneous applications, if any, pending shall stand closed.
