THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.9885 of 2017 ORDER:
This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, the petitioner prays this Hon'ble Court may be pleased to issue an Order or direction more particularly in the nature of WRIT OF MANDAMUS declaring the inaction of the respondents in not releasing pending subsidy portion payable to the petitioner for a sum of Rs.42,82,800/- towards supply of 14 No's Kubota Mini Tractors and 14 No's Kubota Rotavetors, in spite of lapse of more than one year as illegal, arbitrary, high-handed and colorable exercise of power and also violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents to release necessary funds to clear the subsidy portion to the petitioner immediately." Heard learned counsel for petitioner and learned Government Pleader for respondents.
The information available before this Court reveals that in the course of redressal of grievance of the petitioner, the Director of Sugar & Cane Commissioner, Telangana State, Hyderabad, respondent No.2, addressed a letter vide Rc.No.35/2015/E2, dated 28.10.2016, to the Principal Secretary to Government, Industries & Commerce Department, Telangana, Hyderabad, respondent No.1.
AVSS, J W.P.No.9885 of 2017 It is submitted by the learned counsel for the petitioner that no action has been taken by respondent No.1 for redressal of the grievance of the petitioner. A request is made by the learned counsel for the petitioner to direct respondent No.1 to take appropriate action pursuant to the letter, dated 28.10.2016, within stipulated time.
On the other hand, it is submitted by the learned Government Pleader that appropriate action would be taken in accordance with law.
Recording the said submissions, without expressing any opinion on the merits of the matter, this Writ Petition is disposed of directing respondent No.1 to take appropriate action pursuant to the letter vide Rc.No.35/2015/E2, dated 28.10.2016, addressed by respondent No.2, in accordance with law, within a period of three months from the date of receipt of a copy of this order. Consequently, Miscellaneous Petitions, if any pending in this Writ Petition, shall stand closed. No order as to costs. _________________ A.V.SESHA SAI, J 10th APRIL, 2017.
