THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.14757 of 2016 ORDER:
The petitioner, who is accused No.52, in Crime No.132 of 2015 of Huzurnagar Police Station, Nalgonda District, filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of his arrest in connection with the above crime, registered for the offences punishable under Sections 406, 420, 468 and 471 of IPC. Heard learned counsel for the petitioner and learned Additional Public Prosecutor.
The case of the prosecution is as under:
On 15-05-2015, P. Kameshwar Rao, Manager, Corporation Bank, Huzurnagar lodged a report stating that in the regular course of their business, agricultural loans were provided to the needy people and the State Government announced debt waiver of crop loans outstanding as on 31-03-2014. It is alleged that the Revenue authorities visited the bank on 07-10-2014 and on verification, 32 loan documents were suspected as forged, upon which they advised the bank to recover 25% of waiver amount already credited to the respected accounts. Subsequently, on verification, it came to light that some of the loanees produced fake documents with the help of the then Village Revenue Officer and forged the signatures of Tahsildar. Basing on the above allegations, the present crime came to be registered.
Having regard to the nature of allegations made and since the petitioner/A-52 is alleged to have cheated the bank to a tune of Rs.1,91,000/- and failed to repay the same, the request of the petitioner is rejected. But, however, the petitioner, if so advised, shall surrender before the concerned Court and move an application for grant of bail before appropriate Court after giving prior notice to the Public Prosecutor, in which event the same shall be dealt with in accordance with law at the earliest.
