HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16038 OF 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondent in demolishing the compound wall and temporary sheds situated in Survey No.245 and 246 admeasuring 411.11 sq.yards situated at Qutbullapur village, Municipality and Mandal, Hyderabad, without taking into consideration of the fact that the petitioner's LRS application is pending before the second respondent and without passing any final orders on the representations dated 30.04.2016 and 03.05.2016 as arbitrary and illegal.

Heard both the counsels.

Petitioner was issued notice under Section 452(1) of Greater Hyderabad Municipal Corporation Act on 16.10.2015. In pursuance of the same, petitioner made an application on 30.04.2016 for regularization of lay out of the plot and also made an application on 03.05.2016 for regularization of the construction and also paid necessary amounts. Without disposing of the same, the respondents are trying to demolish the subject property, in respect of which applications are pending.

Since it is stated that applications dated 30.04.2016 and 03.05.2016 are pending, the concerned authority among the respondents 2 and 3 shall dispose of the applications within a period of two weeks from the date of receipt of a copy of this order. Till then, there shall be stay of demolition of the subject property.

With the above direction, the writ petition is disposed

of. There is no order as to costs. Consequently, miscellaneous petitions pending if any in this writ petition shall stand closed.
