Heard Sri Shaik Rizwan Ali, counsel for the petitioner and Sri G. Seshadri, standing counsel for the 3rd respondent.

2. The petitioner challenges the rejection of petitioner's request made through the applications dated 26.03.2012 and 27.03.2012 for construction of buildings in Plot Nos.31, 32, 33 and 34 and Plot Nos.43, 44, 45 and 46 in Sy.No.48 of Bestavaripeta Village, as illegal and arbitrary.

3. On instructions, Mr. G. Seshadri, submits that the Gram Panchayat, in fact has sanctioned lay out. But due to a procedural lapse, the lay out is not approved by the Director Country and Town Planning. However, according to him, several buildings have come up in the neighbourhood and request the court to direct the 3rd respondent to reconsider the applications dated 26.03.2012 and 27.03.2012 and pass appropriate orders.

4. In view of the submission, the writ petition is disposed of by this order:

(a) The petitioner is given liberty to re-submit the applications dated 26.03.2012 and 27.03.2012, within eight weeks from the date of receipt of a copy of this order, to the 3rd respondent. (b) The 3rd respondent is directed to consider the request of the petitioner for building permission and pass orders, keeping in view the attendant circumstances in the locality.

No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence. ____________ S.V.BHATT, J Date: 21.02.2017 BSS
