THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.15079 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.

The petitioner was appointed as fair price shop dealer of Shop No.33 of Nizampur Village, Sadasivapet Mandal, Medak District. His authorization was valid till 16.04.2015.

The inspection of the shop was conducted and it was found that there is some variation in the stock, and u/s.6-A of E.C. Act proceedings were initiated and they are pending. However, the third respondent-Revenue Divisional Officer, Sangareddy issued a show cause notice dated 11.05.2015 and suspended the authorization of the petitioner pending enquiry on the same day i.e., 11.05.2015. Challenging the said order, the present writ petition is filed. A show cause notice was issued levelling the following allegations:

"1. That the dealer has having deficit of 4.43 Qtls of PDS Rice, 0.07 Qtls of R.G. Dal and excess of 110 packets of Sugar as per the book balance and ground stock, thus violated the Clause 22 of sub clause (viii) of the A.P.S.P.D.S. (Control) Order, 2008.

2. That the dealer has diverted 2.00 qtls of Rice to one Sri Kotmla Pentaiah's House, thus he violated the Clause 17 of Sub clause (b) of the A.P.S.P.D.S. (Control) Order, 2008."

The petitioner submitted his explanation on 23.05.2015. The enquiry is not yet completed.

In the circumstances, the third respondent is directed to complete the enquiry within a period of 30 days from the date of receipt of a copy of this order by following due process of law and pass final orders thereon.

With the above directions, the writ petition is disposed of. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. No order as to costs.
