THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9682 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.2 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.14 of 2016 on the file of Mothugudem Police Station, East Godavari District, registered for the offences punishable under Sections 8(c ) r/w 20(b)(ii)(C) of the NDPS Act.

Heard and perused the material available on record. It is alleged that the petitioner and another were found in transporting ganja of 200 kgs.

Learned Counsel for the petitioner submitted that the petitioner did not commit any offence and he was falsely implicated in the above crime and that the petitioner was arrested on 8.4.2016 and since then, he has been in prison.

Learned Additional Public Prosecutor opposed this petition on the ground of seizure of commercial quantity of ganja from the possession of the petitioner and another.

Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioner at this stage.
