THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.1890 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor. Perused the material on record.

2. The present Criminal Revision Case came to be filed under Sections 397 and 401 Cr.P.C., by the petitioner/A.2 challenging the order dated 04.07.2016 passed in Crl.M.P.No.55 of 2016 in Sessions Case No.105 of 2016 on the file of the Principal Assistant Sessions Judge, Tirupati, Chittoor District, wherein and whereby the petition filed by the petitioner/A.2 under Section 227 Cr.P.C., to discharge him for the offences punishable under Sections 120-B and 307 read with 34 IPC, was dismissed.

3. Though various grounds are raised in the petition, learned counsel for the petitioner restricts his prayer to dispense with the presence of the petitioner before the Court below on every date of adjournment of the case.

4. Learned Additional Public Prosecutor opposed the same.

5. Having regard to the circumstances of the case, presence of the petitioner/A.2 before the Principal Assistant Sessions Judge, Tirupati, Chittoor District in Sessions Case No.105 of 2016 is dispensed with, except on the dates when his presence is specifically required by the Court below.
