HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24362 OF 2017 ORDER:

Heard learned counsel for petitioner and learned Government Pleader for respondents 1 to 3. None appeared for respondents 4 to 6 in spite of service of notice.

The petitioner is a retired teacher. Challenging the high handed action of the respondents 4 to 6, he lodged a complaint with P.S., Manthani, who registered crime No.123 of 2016 on 30.10.2016 against the sixth respondent. When the respondents 4 to 6 demolished the village secretariat building, he lodged another complaint in crime No.124 of 2016. He also filed W.P.Nos.14561, 15014 and 15124 of 2017 and they are pending. He also lodged a complaint with the authorities for taking action against respondents 4 to 6. While so, when the second respondent passed an order on 27.05.2017 keeping the fourth respondent under suspension for a period of three months, it appears that the fourth respondent filed a Revision before the Government. The Government issued Memo dated 06.06.2017 granting stay of orders of suspension dated 27.05.2017. Challenging the said order, the present writ petition is filed.

A perusal of the order of the second respondent shows that it was passed for a period of three months and the period already expired. In view of the same, nothing remains to be considered by the Government in the pending Revision and as such, the Revision becomes infructuous. Since the order passed by the second respondent itself expired, no relief can be granted, except giving liberty to the second respondent to take appropriate action in accordance with law pursuant to the representations/complaints lodged by the petitioner against the respondents 4 to 6.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed.
