THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.34900 of 2018 ORDER:

Today, when the matter is taken up, written instructions furnished by the Station House Officer, L.B. Nagar Police Station, Rachakonda Commissionerate dated 20.11.2018 are placed on record by the learned Government Pleader. The said instructions read as under: "It is submitted that the 4th respondent herein i.e. N.Janani has given a petition dated 16.9.2018 to the Inspector of Police, L.B. Nagar Police Station stating that the petitioners herein have taken hand-loan of Rs.20.00 lakhs from her and as they failed to repay the said amount within one month as promised by them, she requested for return of the amount, but instead of repaying the amount, they abused her in filthy language. Her visits to their house also did not yield any results. Because of their attitude, she is under tremendous pressure and mental agony. She requested to take necessary action against the said persons for the acts committed by them.

It is submitted that, based on the contents of the petition dated 16.9.2018 given by the 4th Respondent, a GD entry was made in the station records and taken up for enquiry. The petitioners as well as the 4th Respondent were enquired. The enquiry revealed that the subject matter is money transaction and purely civil in nature. The enquiry also proved that no cognizable offence has taken place. Moreover, the complainant i.e., the 4th Respondent is not residing within the jurisdiction of L.B. Nagar Police Station. Hence, no further action was taken on the petition given by the 4th Respondent. The 4th Respondent was also informed that the Police cannot interfere with the subject matter of the petition as it is purely civil in nature and she may approach the concerned Civil Court and a notice in this regard was also given to her.

It is submitted that, in order to ascertain the truth or otherwise of the petition given by the 4th Respondent, the petitioners were enquired and the enquiry revealed that the transaction between the petitioner and the 4th Respondent are purely civil in nature. It is

submitted that, except conducting enquiry on the petition given by the 4th Respondent against the petitioners herein, the Police have not interfered with the civil disputes or pressurized the petitioners to settle the matter with the Respondents 4 and 5.

In reply to the allegations made in pars-5 of the affidavit, it is submitted that the allegations made therein are not correct and hereby denied. The Police have not detained the petitioners in the Police Station as alleged in the affidavit. The Police have not pressurized the petitioners to settle the matter with the Respondents 4 and 5. It is denied that the Police have threatened the petitioners of dire consequences if they did not settle the matter with the Respondents 4 and 5." Having regard to the above, the writ petition disposed of by placing on record the above instructions. As a sequel, the miscellaneous petitions, if any, shall stand closed.
