CVNR,J C.C.No.383 of 2016 18.11.2016 ORDER:

Alleging that the order, dated 07.01.2016, in W.P.No.619 of 2016 of this Court directing the respondents to consider the petitioner's application for building permission strictly within the parameters of the provisions of the Greater Hyderabad Municipal Corporation Act, 1955, based on his lawful possession and prima facie title, is willfully disobeyed, the writ petitioner filed this contempt case.

At the hearing, Mr.Ancha Panduranga Rao, learned standing counsel for the Greater Hyderabad Municipal Corporation (GHMC) appearing for the respondents, has submitted that on 31.03.2016, an endorsement was sent to the petitioner requiring him to pay certain amounts representing the statutory fees under various heads and that on compliance of the requirements shown in the said endorsement, the respondents will sanction and release the building plan. He has further pointed out that submission of up to date paid Vacant Land Tax (V.L.T.)/House Tax receipt is one of the conditions mentioned at serial No.13 of the said endorsement and that on submission of such receipt by the petitioner, the building plan will be sanctioned and released. It is further submitted that as and when the petitioner approaches the respondents for assessment of V.L.T., the assessment will be made and tax offered by the petitioner will be received.

The above submissions of the learned standing counsel for GHMC are placed on record and the Contempt Case is closed, with liberty to the petitioner to avail the remedy of filing a fresh Contempt Case, in the event the undertaking given by the learned standing counsel as recorded above is not complied with by the respondents.
