M/S Zenotech Laboratories Ltd., v. Commissioner Of Police

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12381 of 2012 ORDER:

The grievance of the petitioner company was that the police authorities were not conducting a proper investigation in Crime No.32 of 2012 on the file of Shamirpet Police Station, Cyberabad. A consequential direction was sought to the Commissioner of Police, Cyberabad, to refer the matter to the Cyberabad Central Crime Station for an expeditious investigation.

The Station House Officer, Shamirpet Police Station, furnished written instructions dated 11.09.2015 to the office of the learned Government Pleader for Home, wherein he stated that upon the private complaint made by the petitioner company before the learned VI Metropolitan Magistrate, Ranga Reddy District, at Medchal, against the 5th respondent and an other, Crime No.32 of 2012 was registered on the file of Shamirpet Police Station under Sections 379 and 406 I.P.C. read with Section 120-B I.P.C. A final report was stated to have been filed before the competent court referring the matter as 'civil in nature'.

However, pursuant to the filing of a protest petition by the petitioner company, the matter was directed to be re-investigated by the Central Crime Station, Kukatpally, upon which the Inspector of Police, Central Crime Station, Kukatpally, examined the petitioner company's complaint and verified the documents. However, the petitioner company failed to co-operate with the investigation and did not produce the material evidence and records sought by the Investigating Officer. The Station House Officer further stated that the investigation required examination of different agencies and experts in India and overseas witnesses.

In these circumstances, the Commissioner of Police, Cyberabad, was requested to transfer the case to CID for further investigation. Thereupon, the Commissioner of

Police, Cyberabad, addressed letter C.No.143/C2/Cyb/2014 dated 04.09.2014 to the Additional Director General of Police, CID, Telangana, Hyderabad, transferring the case to the CID. Presently, the CID was stated to be seized of the matter. In the light of the afore-stated developments, the grievance of the petitioner company as to entrustment of the case to the Cyberabad Central Crime Station stands settled. In fact, the matter is now entrusted to the CID.

The writ petition has therefore become infructuous and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
