THE HONOURABLE SRI JUSTICE A.V.SESHA SAI Writ Petition No.12669 of 2017 ORDER:

The Writ Petition is filed for the following relief : "to issue writ, order or direction more particularly in the nature of Writ of Mandamus directing the respondents more particularly respondent No.4 to pass the award in file No.B/1863/2007 in respect of petitioners buildings/open plots situated at Vikarabad, Vikarabad District acquired for the purpose of road widening from Anantagiri Railway track to Alampally via NTR X Roads, Vikarabad District under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and pay the compensation to the petitioners in respect of their respective properties without any further delay." 2.

When the matter is taken up, the written instructions furnished by the Revenue Divisional Officer, Vikarabad Division vide Lr.No.B/1863/2007, dated 17.4.2017 have been placed on record. The said letter reads as under : "I invite kind attention to the references cited. It is to inform that in this case the Award passed on 18.3.2017 and available funds (10,00,00,000) paid to some of the Awardees who are filed contempt case in C.C.No.391 of 2017 in common orders in W.P.Nos.3116, 4675 and 15352 of 2016. And this office requested to EE, R&B, Vikarabad to provide remaining funds. Soon after receipt of the funds, amount will be paid to the writ petitioners. Hence, you're requested to take time for a period of 6 months for payment of amounts."

Having regard to the nature of controversy and taking into consideration the submissions made by the learned counsel for petitioners, so also the learned Government Pleaders for Land Acquisition and R & B,

this Court is of the opinion that the interest of justice would be served if respondents are directed to pay compensation to petitioners herein for the lands acquired within a period of six months from today. 4.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

As a sequel to it, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
