HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30460 OF 2011 ORDER :

The writ petition is filed challenging the initiation proceedings issued under Section 13 and 14 of the A.P.Urban Area Development Act, 1975. When the matter is listed in the year 2011, no stay was granted and thereafter the matter was adjourned several times at the instance of the petitioner. When the matter is ultimately listed on 02.06.2015, petitioner was not present and this Court ordered to post the matter, today, under the caption 'for dismissal'. Today, when the matter is listed, again learned counsel for the petitioner sought time. On the other hand Smt.K.Mani Deepika, learned counsel for the 2nd respondent states orders were passed in S.T.C. and that the petitioner filed appeal against the said STC orders. The same was not disputed by the learned counsel for the petitioner.

Since it is stated by the learned counsel for the 2nd respondent that STC orders were passed and petitioner has already filed appeal challenging the STC orders, the cause in the writ petitions does not survive for adjudication. As such, the writ petition is dismissed. Since the petitioner has filed appeal before the concerned authority, it is for them to pursue the same. No costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
