THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.43111 OF 2016 ORDER :

Petitioner is aggrieved by the notice issued under Section 452 (1) and 461 (1) dated 04.10.2016 and further notice under Section 452 (2) of the Greater Hyderabad Municipal Corporation Act (for short 'the GHMC Act') dated 13.10.2016. 2.

Heard learned counsel for the petitioner and learned Standing Counsel for the GHMC.

Learned counsel for the petitioner submits that these two notices were served on the petitioner on 08.12.2016 and without giving due opportunity, further action is being contemplated. 4.

Admittedly, even according to the petitioner, these two notices are served on 08.12.2016. Even these two notices require the petitioner to explain and if the petitioner do not respond, the next stage would be passing orders under Section 636 of the GHMC Act. Admittedly so far no orders are passed under Section 636 of the GHMC Act. Therefore, the writ petition is not maintainable.

Accordingly, the Writ Petition is dismissed granting liberty to the petitioner to file application before the competent authority informing him about service of notice on the same day as well as furnishing of his explanation as required. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
