Gannapureddy Naga Bhaskar Rao v. The State Of Telangana,
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17965 OF 2017 ORDER:
1.
This writ petition is filed by the petitioners seeking to direct respondents Nos.2 and 3 not to insist the petitioners for payment of two lakhs in relation to Crime in COR No.17 of 2017, which was registered against the petitioners.
2.
The case of the petitioners is as follows:
The 1st petitioner is the father of the 2nd petitioner. They are running the business in the name and style of M/s Varasiddhi Vinayaka Kirana General Merchant at Haliya Village and Mandal, Nalgonda District under valid license. Earlier, one year ago, a crime was registered against the 2nd petitioner in the Excise Police Station, Haliya. The Excise Officials and Tahsildar forced the 1st petitioner to enter into a bond and they got signatures of the 1st petitioner forcibly. It is alleged that the petitioners have not informed in the concerned police station for every 15 days about the sales and stock. On that ground, respondents Nos. 2 and 3 are insisting to pay two lakhs on the ground that the petitioners violated the earlier bond executed by them.
3.
Heard and perused the material available on record. 4.
Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, this Court is inclined to pass the following order: "The respondents are directed not to take any coercive steps against the petitioners. They are further directed to issue a notice
to the petitioners regarding the alleged violations, conduct enquiry and pass appropriate orders in accordance with law." 5.
With the above direction, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous petitions pending, if any, shall stand closed. _________________ JUSTICE RAJA ELANGO Dated: 6th June, 2017 Nn.
