THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20806 of 2016 ORDER :

The present Writ Petition came to be filed seeking to issue writ of mandamus declaring the action of respondent Nos.3 and 4 in calling the petitioner to police station and pressurizing him to hand over possession of the land admeasuring Ac.2.40 cents in survey No.109/1 situated at Chittaturu village, Thottembedu mandal, Chittoor district to unofficial respondent No.6 under the guise of letter of respondent No.4 dated 21.05.2016 bearing R.O.C. No.B/59/2016 and thereby causing interference in civil disputes contrary to the orders passed in C.R.P.M.P. No.3232 of 2015 in C.R.P. No.2414 of 2015, dated 30.11.2015, as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for respondents 1 to 4. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this Court is not deciding the case on merits, it may not be necessary to hear unofficial respondent No.6.

3. Though several grounds are urged in the Writ Petition, learned counsel for the petitioner restricted his prayer seeking a direction to respondents 3 and 4 not to

interfere in the civil dispute between the petitioner and unofficial respondent No.6 in respect of the aforesaid land. The learned Assistant Government Pleader appearing for respondents 1 to 4, on instructions, denied the alleged interference and stated that the respondents are discharging their legitimate duties in accordance with law. Recording the said submission, the Writ Petition is disposed of making it clear that any action taken by the police shall be in accordance with law and any interference shall only be pursuant to the order passed by the competent civil court. No order as to costs.
