THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO W.P.No.24235 of 2015 ORDER:

The 1st petitioner claims to be the owner of Maruti Alto bearing No.AP 28 AW 2481 and dealer of F.P. shop No.691 of RGK, Laxmiguda, , Rajendranagar (Urban), Ranga Reddy District and the 2nd petitioner is the owner of Auto Trolley bearing No.AP 29 TC 1380. While so, the 3rd respondent registered Crime No.351 of 2015 dated 28.05.2015 under Section 7(1) of the Essential Commodities Act alleging that the petitioners indulged in diverting the PDS rice and kerosene oil, and seized the vehicles. Challenging the action of the 3rd respondent the present writ petition is filed. Heard learned counsel for the petitioners and learned Government Pleader for Home.

Since Crime No.351 of 2015 was already registered by the 3rd respondent, the 3rd respondent is directed to produce the seized vehicles, viz., Maruti Alto bearing No.AP 28 AW 2481 and auto trolley bearing No.AP 29 TC 1380 before the competent Court immediately after receipt of a copy of this order. Liberty is granted to the petitioner to take appropriate steps in accordance with law for release of the vehicles.

With the above direction, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
