Heard.

The petitioner aggrieved by the resumption order passed under Section 4 of the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977 by the Mandal Revenue Officer, Ongole in Rc.A.347/2008, dated 28.03.2008, preferred Appeal No.3840 of 2010, which is now stated to be pending before the 3rd respondent. The petitioner states that he has attended on all dates of hearing including the last date i.e. 27.04.2013 and filed written arguments. However, till date, the 3rd respondent has neither completed the hearing of the appeal or the stay petition. Complaining that the 4th respondent is trying to implement the resumption order pending the appeal, the present writ petition is filed.

Considering the fact that the petitioner's appeal is pending since 2010, it is appropriate to direct the 3rd respondent to fix an early date, after notice to all the parties, hear and decide the appeal itself expeditiously preferably within a period of one month from today. Status quo existing as on today with regard to the land covered by the resumption order shall be maintained till the 3rd respondent passes the appropriate orders.

With the above observation, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
