THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.21900 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a permanent fair price shop dealer of Shop No.18 of Kothapalem Village, Rajupalem Mandal, Guntur District. While so, the third respondent inspected the shop on 09.12.2014 and nothing adverse was found. When the stock was not supplied, the petitioner filed W.P.No.1007 of 2015 and this Court, by order dated 28.01.2015, directed the respondents therein to supply the stock. Thereafter the shop was inspected by the Revenue Inspector and he did not find anything adverse. When the stock was not supplied even though the authorization of the petitioner is valid, he filed another W.P.No.16291 of 2015 and the same was disposed of by this Court on 10.07.2015 directing the respondents therein to supply the stock. In the meanwhile a show cause notice was issued to the petitioner on 20.06.2015 and the authorization of the petitioner was also suspended on the same day. Challenging the same, the present Writ Petition is filed.

This Court perused the order passed on 20.06.2015 by the second respondent which states that the petitioner was not discharging the duties of the fair price shop dealer from 25.04.2015 without obtaining any permission from the authorities. However, her brother-in-law distributed the essential commodities in the month of May, 2015. The petitioner was arrested in connection with a crime registered under the Essential Commodities Act. In those circumstances, the authorization of the

petitioner was suspended pending enquiry.

4. The learned counsel for the petitioner submits the petitioner submitted her explanation and the same is pending consideration. In view of the pendency of the enquiry in respect of the specific allegations, this Court is not inclined to interfere with the enquiry process at this stage. However, the third respondent is directed to conduct an enquiry in respect of the allegations against the petitioner and complete the same within a period of 60 days from the date of receipt of a copy of this order.

5. The Writ Petition is, accordingly disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
