THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY APPLICATION No.1364 OF 2016 IN COMPANY PETITION No.2 of 2013 ORDER:

This application is filed by the applicant seeking the following reliefs:

i) Appoint a Valuer from the panel maintained by office of the Official Liquidator for making valuation of movables assets of the various companies in liquidation lying at Dilshad Plaza and Corporate Bhawan and submit his report to the Official Liquidator;

ii) Fix the remuneration of the valuer;

iii) Permit the Official Liquidator to pay the valuer's remuneration and meet other incidental expenses out of the funds of the company;

iv) Permit the Official Liquidator to file a sale application on the basis of valuation report to be submitted by the valuer so appointed by the Hon'ble Court;

v) Order the Costs of this application do come out of the assets of the company.

Heard the learned counsel appearing for the applicant-Official Liquidator.

In view of the facts stated in the affidavit filed in support of the Company Application, this Court is of the opinion that certain movable items as mentioned in Annexures B to H, relating to C.P.Nos.250 of 2010; 218 of 2010; 126 of 2012; 2 of 2013; 38 of 2014; 133 of 2012 and R.C.C.No.2 of 2013 have been stored in the godown / Record room of the Office of the Official Liquidator at Dilshad Plaza, Koti, Hyderabad and

also at Corporate Bhawan, Bandlaguda (Nagole), Tattiannaram since long time without any use and there is every possibility of rustication and reduction in their value. In that view of the matter, it is necessary to appoint a valuer for assessing the present market value of the above said properties.

Accordingly, the Company Application is allowed appointing Sri K. Dhanapathi Rao, Chartered Engineer, Government Registered Valuer, HIG. 35, Phase-V, Near Telephone Exchange, K.P.H.B Colony, Kukatpally, Hyderabad, as a Valuer for making valuation of movables assets of the various companies in liquidation lying at Dilshad Plaza and Corporate Bhawan and submit his report to the Official Liquidator within a period of two weeks from the date of receipt of copy of this order. Valuer fixed at Rs.1000/-.
