This petition is filed, by the petitioner, who is the respondent in the DVC, seeking for quash of the proceedings in DVC No.32 of 2013 on the file of the court of III Metropolitan Magistrate, Traffic Mobile Court, Hyderabad.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the 1st respondent as well as the counsel appearing for the 2nd respondent.

The counsel for the petitioner submits that the allegations made against the petitioner are baseless. The counsel contends that the petitioner and the 2nd respondent are residing separately.

A perusal of the complaint would show that the petitioner and the 2nd respondent lived together. However, when there are specific allegations with reference to specific instances in the complaint, this Court is of the opinion that it is a matter to be enquired into by due trial.
In the light of the above, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
