THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.24359 OF 2012 DATED: 02.07.2015 Between:

R. Nageshwar Goud and another .. Petitioners And The State of Andhra Pradesh, Home Department, Rep. by its Principal Secretary, Hyderabad and others.

.. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.24359 of 2012 ORDER:

The grievance of the petitioners was that the police authorities were pressurizing them to sell their land to the 5th respondent. The Sub-Inspector of Police, Keesara Police Station, Cyberabad Commissionerate, filed a counter-affidavit stating that upon the private complaint made by the 5th respondent before the learned X Metropolitan Magistrate, Cyberabad, at Malkajgiri, Crime No.168 of 2012 was registered under Sections 406, 420 and 506 I.P.C. on the file of Keesara Police Station, Cyberabad. The petitioners were shown as the accused therein. Upon due investigation, a charge sheet was laid before the learned X Metropolitan Magistrate, Cyberabad, at Malkajgiri, and was taken on file in C.C.No.884 of 2012. The case was stated to be pending trial. This counter-affidavit was filed as long back as on 20.09.2012. In the light of the afore-stated facts, the allegation of the

petitioners that the police authorities were pressurizing them to sell their land to the 5th respondent is shown to be without basis. As the 5th respondent lodged a complaint against the petitioners, which was taken on file by the Keesara Police Station as Crime No.168 of 2012, they were bound to carry out investigation and in that process, examine the petitioners. In any event, as the registration of the offence has already culminated in a calendar case which was taken on file by the competent criminal court, their apprehension that the police would pressurize them is unfounded.

The writ petition is therefore closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
