HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 9614 of 2015 ORDER:

It is the case of the petitioner that elections to the Primary Agricultural Cooperative Society Limited, Chilukur (for short 'the Society'), Nalgonda District were conducted on 04.02.2013 and 13 directors were elected, including the petitioner.

In spite of notice dated 04.12.2014 by the petitioner, who is the Chairman of the Society, for attending committee meetings, respondent Nos.4 and 5 remained absent for three consecutive meetings held on 18.12.2014, 06.01.2015 and 21.02.2015. Therefore, the petitioner submitted an application to the third respondent for taking necessary action under the provisions of the Andhra Pradesh Cooperative Societies Act, 1964 (for short 'the Act'). As no action was taken, the present Writ Petition is filed. Pursuant to the application of the petitioner, who is the President of the Society, the third respondent ought to have taken action in accordance with the provisions of the Act. The inaction of the third respondent cannot be appreciated when a representation is received from the Chairman/President of the Society.

In the circumstances, the third respondent is directed to consider the representation of the petitioner dated 25.03.2015, conduct an enquiry, after giving due notice to respondent Nos.4 and 5, and pass orders in accordance with law, within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
