This writ petition is filed praying the following relief: "To issue an appropriate writ or order or direction more particularly in the nature of writ of mandamus declaring the action of the respondents in not drawing the Grade pay sanctioned in Revision of Pay Scale 2009 to the petitioner from 1.4.2009 and not paying the difference Gratuity, difference of Earned leave Encashment and difference of pay and Allowances, as unjust, arbitrary, discriminatory contrary to law and in violation of Article 14 and Article 21 of the Constitution of India and direct the respondents to draw the Grade pay to the petitioner with effect from 01.04.2009 and to pay consequential retirement benefits to the petitioners." 2.
When the matter is taken up for consideration, learned counsel for petitioner, on instructions, submits that after institution of the writ petition, petitioner was granted promotion to the cadre of Executive Director w.e.f. 01.04.2009 and as a consequence, the grade pay was also added to his revised scale of pay and all the benefits, to which he is entitled, were granted and in view of the same, the cause in the writ petition does not survive and it has become infractuous.

Recording the same, writ petition is disposed of as infractuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
