THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1826 of 2015 ORDER:

This Contempt Case is filed alleging violation of the order in W.P.No.40681 of 2014 dated 30.12.2014.

This Court disposed of the said writ petition with a direction to the respondents to consider the case of petitioner for promotion to the post of Accountant Grade-I subject to his eligibility and taking into consideration the quashing of criminal case and also setting aside the punishment imposed against him in the departmental enquiry by this Court in W.P.No.10185 of 2014. The respondent filed a counter affidavit enclosing a copy of the order dated 21.10.2015, which is a speaking order, rejecting the case of petitioner with the following observations: "The request of Sri Y.Md. Khaleem, Acct. Gr.II, District Office, Ananthapuramu for promotion to the cadre of Acct. Gr.I has been examined in detail and his case for promotion cannot be considered at this juncture and he is informed that his candidature will be placed before the next Departmental Promotion Committee meeting duly following the rules and procedure as per his eligibility. His request is hereby disposed in compliance with the orders of the Hon'ble High Court in W.P. No.40681/2014, dated 30.12.2014."

In view of the above, this Contempt Case is dismissed. No order as to costs. However, liberty is given to the petitioner to challenge the orders passed by the authorities in a separate proceedings.
