THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.43134 of 2016 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Sri N.Ranga Reddy, learned counsel for the petitioner, put forth his submissions on the merits of the order passed by the Appellate Deputy Commissioner. When asked when the petitioner had received a copy of the order of the Appellate Deputy Commissioner, learned counsel stated that a copy of the order was received by the petitioner only on 23.11.2016. The contentions urged by the learned counsel require us to record a finding on facts. The A.P.VAT Appellate Tribunal is the proper Forum for adjudication of such factual disputes. We see no reason, therefore, to entertain this writ petition.

As the petitioner has an effective alternative remedy of an appeal to the A.P.VAT Appellate Tribunal, the Writ Petition is dismissed granting him liberty to approach the Tribunal. Miscellaneous Petitions pending, if any, shall also stand dismissed.
