THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.124 OF 2016

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 28.12.2015 passed by this Court in W.P.M.P.No.53686 of 2015 in W.P.No.41587 of 2015.

The learned Government Pleader for Transport however states that though there was lapse on the part of the petitioner, the Regional Transport Officer, Khammam, passed an order on 18.01.2016 in the context of release of the petitioner's vehicle. In the light of the afore-stated development, no willful disobedience is made out warranting exercise of contempt jurisdiction. Though Sri A. Jagan, learned counsel for the petitioner, would contend that there are several issues which require to be examined, such an exercise cannot be undertaken by this Court in contempt proceedings. It shall therefore be open to the petitioner to take recourse to appropriate remedies available in law if he is aggrieved by the order dated 18.01.2016.

The contempt case is accordingly dismissed. No order as to costs.
