THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2343 OF 2015 ORDER:

This Criminal Revision Case is filed by the petitioner, under Sections 397 and 401 of the Code of Criminal Procedure, against the returned endorsement dated 05.10.2015 passed in CFR No.1838 of 2015 in Crime No.13 of 2015 on the file of the Judicial Magistrate of First Class, Satyavedu. Heard and perused the material available on record. The vehicle of the petitioner was seized in Crime No.13 of 2015 on the file of Pichatur Police Station, registered for the offences punishable under Sections 323, 307, 359, 411 or 120-B IPC, 20(1)(C)(iii)(iv)(ix), 29(iv)(A) of AP Forest Act 1967 and Section 3 & 4 of Red Sandal & Sandal Wood Transits Rules 1969 & 55 (2) of Bio Diversity Act, 2002 and Section 27(1) of Arms Act. A perusal of the record discloses that the vehicle of the petitioner was involved in a crime, while it was used in transporting the red sandal wood logs. The petitioner filed an application before Court below for release of the vehicle. The Court below rejected the said application by endorsing that the property was not produced before that Court.

Since the allegations in the complaint, in which the vehicle of the petitioner was involved, are so serious in nature, this Court is not inclined to grant release the crime vehicle.

Accordingly, the Criminal Revision Case is dismissed. Miscellaneous Petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J
