THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 11452 OF 2016 ORDER :

The petitioners, who are accused Nos.1 and 2, filed the present Criminal Petition under Section 438 Cr.P.C. seeking release in the event of their arrest in connection with Crime No.115 of 2016 of Shamirpet Police Station, Cyberabad, registered for the offences punishable under Sections 447, 427, 420, 506 and 379 IPC.

At the time when the matter is taken up for hearing, learned Public Prosecutor would submit that earlier the petitioners filed Criminal Petition No.8154 of 2016 seeking quashing, which was disposed of by an order, dated 15.06.2016 directing the investigating agency to proceed with the investigation but however stayed the arrest of the petitioners for a period of two months from that day. It is to be noted that while disposing of the said Criminal Petition this Court found that there are specific allegations against the petitioners. Having regard to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners, but however, the petitioners, if so advised, shall surrender before the Court concerned and make an application for regular bail after giving notice to Public Prosecutor, in which event, the same shall be considered in accordance with law on the same day.

With the above direction, the Criminal Petition is disposed of.
