The present writ petition came to be filed seeking the following relief:

" To declare the action of the 5th respondent in not registering the Agreement of Sale bearing P.No.655/ 2018 dated 28.04.2018, for sale of Flat No.203 in Akhil Residency Apartment, in Siva Jyoti Nagar Residential Area, Tirupati, as illegal, arbitrary, against the principles of natural justice, contrary to the provisions of the Registration Act, 1908 and unconstitutional and consequently direct the 5th respondent to register the document bearing P.No.655/ 2018 dated 28.04.2018 presented for registration on 23.07.2018, for sale of Flat No.203 in Akhil Residency Apartment, in Siva Jyoti Nagar Residential Area, Tirupati, without referring to the letter of the 4th respondent Roc.A/ 1663/ 2014 dated 31.08.2014."

The learned counsel for the petitioner mainly submits that though the concerned Sub Registrar has received the document in P.No.655/ 2018, till date, neither the document is registered nor any order is passed rejecting the request of the petitioner for registration of the document.

The learned Government Pleader would submit that the subject land is DKT land and as such, the question of registering the apartment built on the said land, does not arise. The same is not seriously disputed by the learned counsel for the petitioner. 4.

Having regard to the above circumstances, the concerned Sub Registrar, before whom the document is presented for registration, shall pass appropriate orders thereon, in accordance with law, as early as possible, preferably, within a period of three weeks from the date of receipt of a copy of this order. 5.

With the above directions, the writ petition is disposed of at the admission stage. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. _________________________ JUSTICE C.PRAVEEN KUMAR 28.09.2018 DMG
