THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12843 of 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue writ of Mandamus to declare the action of the respondents in not considering case of the petitioner for appointment to the post of Conductor or any other suitable job under the Bread Winner scheme as illegal, unjust, contrary to law, arbitrary, discriminatory and violative of Articles 14, 16 and 21 of the Constitution of India; and grant all consequential benefits." Heard Sri A.K. Jayaprakash Rao, learned counsel, appearing for the petitioner and Sri A. Rama Rao, learned counsel, appearing for the respondents.
During the course of hearing, it is submitted by the learned counsel for the petitioner herein that the petitioner herein submitted representation to the respondents herein requesting for appointment on compassionate ground. The same has not been considered so far against any suitable posts. It is further submitted by the learned counsel for the petitioner herein that the petitioner herein will submit representation to the respondents once again for his consideration for appointment on Compassionate grounds and the same may be directed to be disposed of, in accordance with law, by fixing some timeframe. For the aforesaid reasons, Writ Petition is disposed of, permitting the petitioner herein to submit representation with a request to consider the case of the petitioner for appointment on
compassionate ground, within a period of one month from the date of receipt of a copy of this order, and if such application is submitted within the time stipulated, the same be considered and appropriate orders be passed, in accordance with law, within a period of two months thereafter.
Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
