THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.132 of 2012 ORDER:
1. This Criminal Revision Case is filed by the petitioner-accused against the order dated 18.1.2012 passed in Crl.M.P.No.4915 of 2011 in C.C.No.15 of 2011 by the XVI Additional Judge, City Civil Courtcum-XX Additional Chief Metropolitan Magistrate, Hyderabad.
2. The 2nd respondent-complainant through his authorized representative, who is his son, filed the complaint in the above C.C. against the petitioner for the offence under Section 138 of the Negotiable Instruments Act. Basing on the authorization letter dated 21.5.2009, the above complaint was filed. But the complainant did not seek permission to represent the case through authorized representative. While the matter was coming for arguments, the complainant filed the above Crl.M.P. seeking permission of the Court to represent the case through authorized representative. The trial Court allowed the above Crl.M.P. Aggrieved by the same, the petitioner-accused filed this revision.
3. Heard and perused the material available on record.
4. The above Crl.M.P. was allowed by the trial Court permitting the 2nd respondent to represent his case through authorized representative, on the ground that granting of permission to the complainant as sought for, would not cause any prejudice to the petitioner-accused. From the material on record, it is obvious that the entire trial in the above C.C. was completed and the representative of the complainant has participated in the proceedings. At this stage of the proceedings, the order of the learned trial Judge would not cause any prejudice to the petitioner.
5. In the above circumstances, this Court is not inclined to interfere
with the order under revision.
6. Accordingly, the Criminal Revision Case is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
