THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION Nos.7829 of 2013, 9911 of 2015 & 121 OF 2016 COMMON ORDER:

Since all these Criminal Petitions are arising out of same proceedings, they are heard together and being disposed of by this common order.

Criminal Petition No.7829 of 2013 is filed by A.2 & A.3; Criminal Petition No.9911 of 2015 is filed by A.4,A.5 & A.6 and Criminal Petition No.121 of 2016 is filed by A.1 under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.21 of 2012 pending on the file of XIII Additional Chief Metropolitan Magistrate at Hyderabad for the offence under Sections 498-A, 406, 420, 506 IPC and Sections 4 & 6 of Dowry Prohibition Act. Heard and perused the material on record.

In Criminal Petition No.121 of 2016 filed by A.1, the father of 1st respondent, who is the wife of A.1 filed a counter affidavit stating that the entire dispute has been settled in United States of America, that A.1 and his wife-complainant both are residing in U.S.A. and that the complainant-wife of A.1 is not interested in prosecuting the matter further.

Learned counsel for the respondent-complainant, after filing the counter, informed that he has no objection for quashing the impugned proceedings in view of the compromise entered between the parties. Considering the contents of the counter affidavit filed on behalf of complainant and since the cases are arising out of the matrimonial disputes, this Court is inclined to quash the impugned proceedings in view of the settlement of the dispute between the parties.

In the result, all the Criminal Petitions are allowed and the proceedings in C.C.No.21 of 2012 pending on the file of XIII Additional Chief Metropolitan Magistrate at Hyderabad are hereby quashed as against the petitioners herein. The petitioners-accused are directed to pay a sum of Rs.5,000/- together towards costs to the Telangana Legal Services Authority, Hyderabad on or before 30th April, 2016. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
