THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.33257 OF 2017 ORDER:

This Writ Petition is filed to declare the action of the respondents in issuing the tender notification dated 24.08.2017 inviting sealed bids for establishment and operation of catering units in various railway stations of Vijayawada Division including Samalkot without considering the petitioner requests for renewal of catering stall at Samalkot in his favour/present license holder to which he was entitled, as illegal and arbitrary. Learned counsel for the petitioner and the learned Standing Counsel for the respondents-Railways would agree for disposal of the Writ Petition at the admission stage.

Learned counsel for the petitioner represented that he filed a representation before the Senior Divisional Commercial Manager, South Central Railway, Vijayawada Division on 25.02.2017 and seeks disposal of the said representation in accordance with law. Learned Standing Counsel for the respondents-Railways does not have objection for disposal of the said representation filed by the petitioner.

The second and the third respondents are directed to dispose of the representation of the petitioner dated 25.02.2017 and the subsequent representation given by the petitioner in November 2017 in accordance with the Circulars issued by the Railway Authorities and pass appropriate orders thereupon within a period of two (2) months from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
