Challenging the order dated 29.10.2015 of the third respondent cancelling the fair price shop authorization of the petitioner, the present Writ Petition is filed. Sri V.R. Reddy Kovvuri, learned Counsel for the petitioner submits that no enquiry as provided under the Andhra Pradesh Public Distribution System (Control) Order, 2008 and in terms of the law declared by this Court in Manjula Vs. District Collector

{2015(3) ALD 617} was conducted.

Having considered the submission of the learned Counsel for the petitioner, this Court is not inclined to go into that aspect as effective alternative remedy of appeal is available to the petitioner before the second respondent who will take into consideration all the allegations raised by the petitioner in respect of both in fact and law. Further, with regard to the allegation of variation of 1.98 quintals of PDs Rice and 1 Kg of sugar, the learned counsel for the petitioner pointed out that the said shortage of commodities are within permissible limits. All these contentions will be gone into in the appeal to be preferred by the petitioner within two weeks from today and the second respondent-appellate authority shall consider the same and pass appropriate orders within four weeks thereafter after giving due opportunity of being heard to the petitioner. Subject to the above, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
