HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37795 OF 2016 ORDER:
The present writ petition is filed by the petitioner seeking to direct the 2nd respondent to pass orders on the protest petition filed by the petitioner in Crl.M.P. No.427 of 2014 in Crime No.532 of 2010 on the file of III Metropolitan Magistrate, Cyberabad at L.B. Nagar. Heard and perused the material available on record. The case of the petitioner is that he filed a private complaint before the 2nd respondent against the 3rd respondent and that the same was referred to the police for investigation. After completion of investigation, the police filed final report stating that the matter pertains to civil dispute. Thereafter, the petitioner filed a protest petition before the 2nd respondent and the statement of the petitioner was also recorded. The 2nd respondent reserved the matter for orders, on 07.09.2015. The grievance of the petitioner is that though one year has elapsed, the 2nd respondent has not passed any orders on the protest petition filed by the petitioner.
After perusing the material available on record, this Court is of the view that the present writ petition, filed under Article 226 of the Constitution of India, is not maintainable. However, considering the facts and circumstances of the case and the grievance of the petitioner, the 2nd respondent is directed to dispose of Crl.M.P. No.427 of 2014, if it is reserved, within a period of fifteen (15) days from the date of receipt of a copy of this order.
With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
