HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No. 505 of 2012 JUDGMENT:

This appeal is preferred against order dated 23.02.2012 in I.A.No.44 of 2012 in O.S.No.3 of 2012 on the file of District Judge, Srikakulam.

2. Appellant herein is plaintiff. The Court below on a consideration of material, dismissed the interim injunction petition holding that plaintiff is not entitled for the relief claimed as he failed to make out prima facie case. Aggrieved by the same, present appeal is preferred.

3. As seen from the case status, the main suit O.S.No.3 of 2012 was dismissed on 04.03.2013 as not pressed and in view of the withdrawal of the suit, nothing survives in this appeal for adjudication.

4. Therefore, this appeal is dismissed as infructuous.

5. Miscellaneous petitions pending, if any, shall stand closed. No costs.
