The case of the petitioner-Association is that though they have filed civil suits and obtained order of Status quo, the respondents are going ahead with the construction. In support of the same they have filed order of status quo passed in IA.No.602/2016 in AS.No.27/2013.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

It is to be seen that if the order of Status quo is violated by the respondents, it is open for the petitioner-Association to take appropriate steps for violation of the Status Quo orders passed by the Civil Court. The petitioner cannot simultaneously pursue both remedies, one, by way of first appeal and another by way of writ petition.

Subject to the above observation, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
