HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.34941 OF 2018 O R D E R :

The only grievance of the petitioner is that his wife by name Chinnapapa died on 03-11-2016 in an accident took place on Chittoor-Puttur road, near G.D.Nellore bus stop, G.D.Nellore while travelling on Hero Honda Passion Pro Motor Cycle bearing No.AP-04-N-0132 along with her son to attend a function at Santhapeta Chittoor town and she being unorganized worker enrolled as beneficiary under Chandranna Bheema policy scheme vide policy No.504003012 dated 02-10-2016 through SERF Agency Chittoor District. Therefore, the petitioner being nominee of the policy issued under the said scheme is entitled to claim benefits, he made application in a prescribed format through online. But the 3rd respondent is not releasing the same. The petitioner issued notice on 10-08-2018. As there is no response from the 3rd respondent, aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner and heard learned Assistant Government Pleader for Social Welfare. Since the application of the petitioner by way of notice dated 10-08-2018 is stated to be pending before the 3rd respondent, it is for the 3rd respondent to consider the same and take action.

Accordingly, this writ petition is disposed of directing the 3rd respondent to consider the application of the petitioner dated 10-08-2018 and take action in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
