JUDGMENT: (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) The respondent - husband in F.C.O.P. No.961 of 2012 filed the present appeal feeling aggrieved by order and decree dt.11.10.2015 of the Judge, Family Court, Hyderabad, granting divorce in favour of his wife, the respondent in the appeal. By the said decree, the Family Court has also awarded Rs.5,00,000/- (Rupees five lakhs only) towards permanent alimony to the respondent. Both the parties have filed F.C.A.M.P. No.159 of 2016 for passing a compromise decree of divorce dissolving the marriage between the parties subject to the terms of the Compromise Memo dt.4.4.2016. Along with the said application, the Memorandum of Compromise signed by both the parties and their respective counsel, is filed.

At the hearing, both the parties are present and informed the Court that they have entered into the Memorandum of Compromise out of their free will and consent. In the light of the above facts, F.C.A.M.P. No.159 of 2016 is allowed. The order in F.C.O.P. No.961 of 2012 on the file of the Judge, Family Court, Hyderabad, is modified in terms of the Memorandum of Compromise.

The Family Court Appeal is accordingly disposed of. As a sequel to disposal of the appeal, F.C.A.M.P. No.52 of 2016 shall stand disposed of as infructuous.
