A. Satyam v. The State Of Telangana

THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.35150 OF 2018 ORDER:

When the matter is taken up, written instructions, dated 01.10.2018, furnished by the Sub Inspector of Police, Chatrinaka Police Station, are placed on record by the learned Government Pleader for Home. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:

"One G.Lavanya, d/o G.Malla Reddy (daughter of the 5th respondent herein) has approached the Assistant Commissioner of Police, Falaknuma Division, Hyderabad and lodged a complaint on 19.5.2018 stating that for the construction of their house, they entrusted the work to the petitioner A.Satyam for which, an amount of Rs.5,90,000/- was paid to him and made an agreement but the petitioner taken the money did not complete the work and ran away and when they are engaging workers and doing work, the petitoenr threatened their workers and when they asked for return of money, he abused in filthy language and harassing mentally and also threatened with dire consequences and hence requested the police to take necessary action as per law.

Upon receipt of the said petition, the said petition was forwarded it to the SHO, Chatri naka Police Station for necessary action on verification of the facts of the case and accordingly, an entry was made into the Station General Diary , after enquiry action will be taken.

In the enquiry it is clearly revealed that the dispute of the complainant as well as the petitioner herein is purely civil in nature relating to money transaction and hence immediately advised the complainant who is the daughter of the 5th respondent herein to seek their redressal in a competent court of law. As of now, no, case whatsoever was registered against the petitioner herein on the file of Chatrinaka Police Station, Hyderabad.

While the matters stood thus, on 16.9.2018 the

petitioner himself telephoned this respondent police station informing that one Smt.G.Manemma/5 respondent herein and her daughter G.Lavanaya who are their neighbors are daily harassing him and abusing him for payment of money and hence requested to take action.

To know the veracity in the oral telephonic conversation and as per the oral request of the petitioner herein, this respondent police summoned the petitioner as well as the 5th respondent and her daughter and got the matter thoroughly enquired with them and immediately advised them to amicably settle their dispute in competent court of law.

It is pertinent to submit that no case whatsoever was registered against the petitioner herein and he is not at all required in any case and this respondent never interfered with the dispute of the petitioner herein or interfering with his day to day life as alleged.

I humbly submit that having bore grudge against his neighbour/5th respondent, the petitioner made false and baseless allegations against this respondent police and they are totally denied.

I humbly submit that this respondent never interfered with civil dispute muchless the dispute of the petitioner herein".

By placing on record the above instructions, Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any pending, shall also stand disposed of in consequence.
