THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37261 of 2015 ORDER:

The grievance of the petitioners is as to the seizure of their vehicles bearing registration Nos.KA32M 9294 (LMV Trax Toofan) and KA33S 5688 (Two Wheeler Hero Honda Passion) by the Station House Officer, Devarkadra Police Station, Mahabubnagar District.

The Sub-Inspector of Police, Devarkadra Police Station, Mahabubnagar District, furnished written instructions dated 23.11.2015 to the office of the learned Government Pleader for Home stating that Crime No.77 of 2015 was registered on the file of the said police station under Sections 380 and 457 I.P.C. basing on the complaint dated 22.05.2015 made by one Ediga Venkateshwar Goud as to a theft committed at his shop. During the course of investigation, the police apprehended accused No.6 and upon his confession statement, they seized various articles including the subject vehicles. The vehicles were thereafter stated to have been deposited before the learned Judicial First Class Magistrate, Atmakur, vide CPR No.335 of 2015 dated 21.11.2015. Pursuant to the order passed by the said Court, the vehicles were kept in the custody of the police authorities.

In the light of the afore-stated facts, it is for the petitioners to approach the competent court under the provisions of the Code of Criminal Procedure, 1973, for release of their vehicles.

Reserving liberty to the petitioners to do so, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
